Scope and object

These Terms and Conditions (hereinafter, the "Terms") govern access to, registration on, and use of the website www.travifo.com (hereinafter, the "Website") and the services offered through it by Travifo.

By registering on the Website or using any of its services, the User fully and unreservedly accepts these Terms. If the User does not agree with any of the conditions set forth herein, they must refrain from using the Website.

Account access and registration

To access the Website's features, the User must create an account by providing truthful and up-to-date information. By registering, the User accepts the following conditions:

  • Minimum age: The User must be at least 14 years old to register and use the Website. Users under 14 require the consent of a parent or legal guardian.
  • Truthful information: The User agrees to provide truthful, complete, and up-to-date information during registration and to keep it current at all times.
  • Credential security: The User is responsible for maintaining the confidentiality of their password and for all activities carried out under their account.
  • Unauthorized use notification: The User must immediately notify Travifo of any unauthorized use of their account or any other security breach.

Service description

Travifo is a platform designed for group travel organizers that offers, among others, the following features:

  • Professional public page: A custom URL with the organizer's information and trips, optimized for sharing on social media.
  • Trip management: Creation and publication of trips with photos, descriptions, dates, pricing, and available spots.
  • Lead capture: A built-in form on each trip that automatically collects contact details from interested parties and sends notifications to the organizer.
  • Participant management: Tools for managing documents, payments, and the status of each participant (available on the PRO plan).

Plans, pricing, and payments

Travifo offers a free plan with limited features (up to 2 active trips, unlimited leads, and a professional public page) and paid plans with additional functionality. Up-to-date details for each plan, including pricing and features, are available in the Pricing section of the Website.

Travifo reserves the right to modify the prices of paid plans at any time. In the event of a price change, the User will be notified at least 30 days in advance via email to the address associated with their account. The new price will take effect from the next billing cycle after the notice period.

Payments are made in advance on a monthly or annual basis, depending on the plan chosen. No refunds will be issued for partial unused periods, unless required by applicable law.

Travifo may offer promotions, discounts, or free trial periods for paid plans, the specific conditions of which will be communicated at the time of activation.

User-generated content

The User retains all intellectual property rights over the content they publish on the platform (texts, photographs, trip descriptions, etc.).

By publishing content on Travifo, the User grants Travifo a non-exclusive, worldwide, royalty-free, and revocable license to display, distribute, and reproduce said content solely for the purpose of providing the service.

The User agrees not to publish content that is illegal, offensive, defamatory, that infringes third-party intellectual property rights, or that contains false or misleading information. Travifo reserves the right to remove any content that violates these conditions.

Obligations and acceptable use

The User agrees to use the Website and its services in accordance with the law, morality, public order, and these Terms. The following activities are expressly prohibited:

  • Spam and unsolicited communications: Using the platform to send bulk, advertising, or unsolicited messages to other users or third parties.
  • Automated data extraction: Using bots, scrapers, or other automated means to extract data from the Website without express authorization.
  • Identity impersonation: Creating fake accounts, impersonating third parties, or providing misleading information about one's own identity.
  • Illegal activities: Using the platform for illegal or fraudulent purposes, or in ways that infringe on the rights of third parties.
  • Malicious software: Introducing viruses, trojans, or other malicious software that may damage the Website or the devices of other users.
  • Service interference: Performing actions that may overload, damage, or interfere with the normal operation of the Website or its infrastructure.

Intellectual and industrial property

Travifo is the owner of all intellectual and industrial property rights of the Website, including its source code, design, navigation structure, brand, logos, and other graphic elements, as well as content not contributed by Users.

The reproduction, distribution, public communication, or transformation, in whole or in part, of the Website's content without the express written authorization of Travifo is prohibited. The User may view and obtain a temporary private copy of the content for their personal and non-commercial use only.

Service availability and continuity

Travifo will make every effort to keep the Website continuously available. However, it does not guarantee uninterrupted availability or the absence of errors in the service.

Travifo reserves the right to modify, suspend, or discontinue any feature or the service as a whole, notifying Users with reasonable advance notice. In the event of a complete discontinuation, Travifo will provide a minimum period of 30 days for Users to export their data.

Maintenance tasks that may cause temporary service interruptions may be performed. Where possible, these will be communicated in advance.

Suspension, cancellation, and account deletion

Travifo reserves the right to suspend or cancel the account of any User who violates these Terms, misuses the platform, or compromises the security or operation of the service, with prior notification except in cases of urgency.

The User may delete their account at any time from the Settings section of the Website. Doing so will permanently delete all their data (profile, trips, leads, participants, and API tokens). The User may export their data in CSV format before proceeding with the deletion.

The services included in the free plan are offered with no commitment. Travifo may discontinue the free plan or modify its features at any time, notifying affected Users at least 30 days in advance to the email address associated with their account.

Limitation of liability

Travifo shall not be liable for any damages arising from the use or inability to use the Website, including, without limitation, loss of data, loss of profits, or indirect damages, except in cases of willful misconduct or gross negligence.

Travifo is not responsible for the opinions, content, or activities of the platform's Users, nor for the truthfulness or accuracy of the information published by travel organizers on their public profiles.

Applicable law and jurisdiction

These Terms are governed by Spanish law. Any disputes arising from their interpretation or application shall be submitted to the jurisdiction of the courts as determined by law.

Modifications to these Terms

Travifo reserves the right to modify these Terms at any time to adapt them to legislative, technical, or functional changes to the platform.

In the event of material modifications, the User will be notified at least 30 days in advance via email and through a visible notice on the Website. Continued use of the service after the new Terms take effect will constitute acceptance.
